Carjacking is the felonious taking of a motor vehicle in the possession of another from the other persons immediate presence, or from the person or immediate presence of a passenger of the vehicle.  The taking must be against the victim’s will through the means of force or fear and with the intent to permanently or temporarily deprive the person of possession of the vehicle.

 

Carjacking is very similar to robbery, but neither is a lesser included offense of the other.

 

Carjacking in California is a felony and is punishable by imprisonment in the state prison for 3, 5 or 9 years.
