“Domestic Violence” is simply an assault or battery against a spouse or cohabitant. In Ventura County California the District Attorney is extremely aggressive on these charges, to the point of a fault, and this is commonly known in the legal community.  Because of this, we have found that many charges which are filed turn out to be baseless or subject to dismissal or reduction.

 

That is not to say that all cases get dismissed.  They don’t.  However, frequently what starts out as a felony can be reduced to a misdemeanor, or result in an acquittal at trial.

 

As a felony these charges subject a defendant to imprisonment in state prison.  As a misdemeanor the punishment is up to one year in county jail.

 

Obviously the scope of the injury to the victim is the key in determining what the punishment will be. Less serious cases can be negotiated to totally eliminate all jail time.  However, all convictions require the defendant to participate in 52 weeks of domestic violence counseling.
