In California the Ventura County District Attorney's office aggressively prosecutes all sex offenses.  There are many different potential offenses that deal with criminal sexual behaviors; some are far more serious than others.  Some are misdemeanors while others are serious felonies that can result in a lengthy prison sentence.

 

Generally almost all sexual offenses are charged as felonies, although some more minor offenses may be charged as misdemeanors. Most of the possible charges include, (1) lewd or lascivious acts, (2) Internet pornography, (3) rape, (4) spousal rape, (5) statutory rape, (6) oral copulation with a minor, (7) possession of child pornography, (8) indecent exposure, and (9) Prostitution.

 

Most charges are brought under California Penal Code section 288, which is captioned Lewd or Lascivious acts.  These charges may be filed as a felony against an individual who willfully and lewdly commits a lewd or lascivious act with a minor.  If the child is under the age of 14 the charge is always a felony can carries increased penalties, including a prison commitment of up to eight years.  The charge may be a misdemeanor or felony against a person who commits this crime with a child who is 14 or 15 years old if the accused is at least 10 years older than the child.
